Kerala High Court removed legal barrier to establish AMU

ALIGARH September 17: A major legal roadblock for establishing AMU Malappuram Center and launching of MBA and BALLB programmes in the current session was removed by the Kerala High Court. The High Court has rejected the prayer of Mr. Janardhanan for interim relief against the establishment of Aligarh Muslim University in Kerala at Perinthalmanna.


The Chief Justice J. Chelameswar and Justice P.N. Ravindran noted that the petitioner has overlooked the language of Section 12(2) of the Act. The Hon’ble High Court of Kerala further observed that the Section 12(2) of the AMU Act reads the University may also, “with the sanction of the Visitor and subject to the statutes and ordinances, establish and maintain such special centers, specialized laboratories or such other institutions for research or instruction as are necessary for the furtherance of its objects either on its own or in co-operation or collaboration with any other institution”.

The writ petition was filed by Mr. K. Janardhanan to “stay all further proceedings of establishment of off campus center of AMU in Kerala and admission to various classes this academic year of Aligarh Muslim University”, Malappuram center at Perinthalmanna pending disposal of the writ petition.

The writ petitioner Mr. Janardhanan claimed to be a public-spirited citizen, practicing lawyer, political activist, educationist, trade unionists, etc. The essence of the grievance of the petitioner was that the first respondent, i.e., AMU took a decision to establish a campus at Malappuram in Kerala and such an establishment is beyond the authority of law confirmed on the university under the Aligarh Muslim University Act.


Regarding the hostel issue, Chief Justice J. Chelameswar and Justice P.N. Ravindran of Kerala High Court were of the opinion that non-availability of a hostel at the initial stages may not by itself be a ground for prohibiting the University from establishing a campus. They further observed that, in view of the pendency of the writ petition (c) No. 15091 of 2010 “We do not propose to make any further in-depth analysis of the writ petition. The above mentioned facts, in our own view, are sufficient to reject the prayer for interim relief. The prayer is accordingly rejected”.

The writ petition argued that the University could establish special centers, special laboratories etc., only within a radius of 25 kilometers of the university mosque in view of the language of the sub-section (9A) of Section 5 of the AMU Act.


Mr. T.P.M. Ibrahim Khan, Assistant Solicitor General of India plead the arguments on behalf of the respondents.


It is to be noted that based on the same plea an old boy of the University Mr. Z.K. Faizan has also filed a writ petition in the Allahabad High Court and the case will come for hearing on 27th of this month.

Committee for the establishment of Special Centre of AMU visited the Malappurram's Campus site

ALIGARH January 8: The Committee constituted by AMU Vice Chancellor Prof. P. K. Abdul Azis to prepare a detailed “Action Plan” for the establishment of Special Centre of AMU at Murshidabad (West Bengal) and Malappuram (Kerala) visited the Malappurram's proposed campus site and held wide ranging consultations with State Government functionaries and citizens of the area today at Perinthalmanna, Kerala.

Mr. V. Sasikumar, Member, Kerala Legislative Assembly from Perinthalmanna who accompanied the visiting team to the site said that the state government and the local people both will extend all possible support to AMU and its special centre. He said that 123 acres of land has already been acquired on fast track basis and that too in a short span of time bears testimony to the significance the people attached to the AMU Special centre in Malappuram.

Mr. Mohan Dut, District Collector of Perinthalmanna while briefing the visiting team said that the process of demarcation was completed and the Kerala Land Information Mission surveyed the land to demarcate 123.69 acres to be acquired in the first phase including the land required for the Main Road (100 feet road) to the campus. The Government constituted District Level Purchase Committee has negotiated with the land owners and fixed the rates ranging from Rs. 8,750 to Rs. 47,000 (for Forty Sq. Meters) according to the type of land. This decision has been forwarded to the government for approval, he said.

While the AMU Committee was holding consultations, the District Collector informed that the State Level Purchase Committee has approved the first phase acquisition rates involving an expenditure of Rs. 13 Crore. The Revenue Minister who was on the phone spoke to Prof. V. K., Abdul Jaleel, AMU Registrar and Leader of the Visiting Team and informed that the Kerala Government will hand over the acquired 123 acres of fist phase land in a Public Function within two weeks.

The State officials also informed that the process of demarcation and land acquisition of balance land out of the total 393 acres is in progress and the special land acquisition staff will complete the task assigned to them in time.

The AMU Visiting Committee comprising Prof. V. K. Abdul Jaleel (Convener), Prof. Pervez Mustajab, Controller of Examinations and Admissions, Prof. Ekram Husain, Prof. Javed Akhtar and Prof. N. A. K. Durrani participated in the review meeting with the officials of various government departments including Revenue, Electricity, Public Works, Land Acquisition, Water Works and CPWD. The team insisted on the time line ad succeeded in evolving a broad consensus that includes handing over of first phase 123 acres land to the University within three weeks of Government notification, fencing of the acquired land including that of the approaching road will be done by the State Government by the end of March 2010. The 10-20 MVA substation will be made ready within six months, portable water supply will be ready within one year and for construction work alternative water arrangement will be made within 3 months. The officials also agreed to provide the list of all tall trees along with the survey map to facilitate holistic planning. They also informed that stone quarry activity was totally stopped in the area earmarked for the setting up of the AMU Centre.

The team also inspected and identified a temporary alternative site for formally launching the AMU Centre in the next academic session in the nearby vicinity.
The State Government officials who were present in the meeting include Dr. K. Vijaykumar, Special Officer, Mr. P. Abdur Rahiman, RDO, Perithalmanna, Mr. P. V. Ramadas, Special Tehsildar (Land Acquisition) , Mr. V. Gopinathan, Deputy Director of Collegiate Education, Calicut, Mr. P. Mohanan, Geologist, Mr. Mohammed Ali K., Executive Engineer & Mr. Jud K. Raphell, Executive Engineer, Kerala Electricity Board, Mr. M. Christtrados, AEE, PWD/Roads, Mr. E. V. Rajgopalan, AEE, Water Works Department, Perinthalmanna and Mr. N. N. S. S. Rao, Superintendent Engineer, CPWD, Calicut also participated in the meeting.

Kerala AMU campus: land acquired for first phase

Kochi: The whole 123 acres of land required to be handed over to the Aligarh Muslim University in the first phase of the setting up of the regional campus in Kerala have been acquired. The acquisition became possible as the land owners last day informed their willingness to hand over the land for the road.

However, reports suggest that attempts are on to postpone the final date for the acquisition of land, which has been previously set to November 30th. The postponement is needed to complete the sketches and reports related to the registration survey of the land.

The land owners got ready for transfer of land after many talks. Around 10 land owners have now got ready to transfer 1.61 acres of land which will be used for the road facility to the campus. The officials had earlier reportedly promised the land owners by word that the registration of land would be over by today (November 30) but even the primary procedures for the same have not yet been done. No accounts have been reportedly created via treasury or banks to transfer the money of land to the owners who handed them over to the government. In short, the registration procedures of the first phase might still take 15 – 20 days to be completed.

Kerala is one of the five states where the Aligarh Muslim University decided to set up its off-campus regional centres. There were problems regarding the selection of land in the state initially but even after land was selected at Perinthalmanna, problems related to acquisition came up. Authorities have decided to acquire the total land in three phases. One hundred and twenty-three acres of land were to be acquired in the first phase which should be over by November 30. But the proceedings suggest that the first phase may not be complete by the stipulated time.
